Terms of Service for Pulse

1. Description of Service

Pulse is a proprietary, internal software application designed for authorized employees and agents of The Insurance Store. The Service integrates with third-party platforms, including Google Business Profile and RingCentral, to centralize customer communications, such as online reviews and text messages, into a single dashboard for management and response.

2. Acceptable Use

You agree to use the Service only for its intended purpose as an internal business communication tool. You are responsible for all activities that occur under your account. You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Post replies to reviews or send messages that are unlawful, defamatory, harassing, abusive, fraudulent, or obscene.
• Attempt to gain unauthorized access to any other user's account or to the Service's underlying systems.
• Interfere with or disrupt the integrity or performance of the Service.

3. Data from Third-Party Services

The Service displays data retrieved from third-party APIs, including but not limited to:

• Google Reviews: Customer reviews, ratings, and reviewer information posted on Google Business Profiles owned and operated by The Insurance Store.
• RingCentral Messages: Text message conversations conducted through The Insurance Store's paid RingCentral subscription.

Your interaction with this data through the Pulse platform must comply with the terms of service of the respective third-party platforms (Google and RingCentral).

4. Intellectual Property

All rights, title, and interest in and to the Service, including its software, design, and user interface, are and will remain the exclusive property of The Insurance Store. These Terms do not grant you any right to use the Pulse name, logo, or any of its intellectual property.

5. Confidentiality

The data displayed within Pulse, including customer comments and contact information, is considered confidential information of The Insurance Store. You agree to handle this information with the utmost care and not to disclose it to any unauthorized third party.

6. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranty that the Service will be uninterrupted, timely, secure, or error-free.

8. Limitation of Liability

In no event shall The Insurance Store be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
